Условия предоставления услуг

Вы можете пользоваться нашими Services только при условии принятия этих Terms. Заказывая или оплачивая любые Services, вы подтверждаете, что принимаете эти Terms как соглашение между вами и Appbox. Эти Terms остаются действительными и применимыми независимо от любого другого договора или договоренности, которые у вас могут быть с Appbox. Если письменное соглашение с Appbox не предусматривает иное, все дополнительные договоренности также регулируются основными условиями, описанными здесь. Если отдельное соглашение с Appbox противоречит этим Terms, приоритет имеет такое отдельное соглашение. Вы также должны быть совершеннолетним, чтобы заключить юридически обязательный договор, и не должны быть лишены права пользоваться Services по законам вашей юрисдикции. Общие условия предоставления услуг

1. Клиент несет ответственность за весь content и все действия в любом тарифе Appbox. Любое действие в userspace клиента, независимо от того, было ли оно разрешено, считается ответственностью клиента. Все users должны соблюдать эти Terms of Service (далее "TOS").
2. Users отвечают за безопасность своих services в соответствии с нашей Password Policy. Appbox не несет ответственности, если user account будет скомпрометирован из-за слабых паролей или передачи login credentials друзьям, родственникам или любой third party.
3. Все user resources, включая applications, должны требовать действительную authentication. Работа открытых или publicly accessible directories запрещена.
4. Клиент отвечает за своевременную оплату всех invoices. Неоплаченные invoices приведут к suspension of service, а если проблема не будет устранена, service может быть terminated, а все stored data удалены. Любая overpayment из-за incorrect recurring payments не возвращается; вместо этого она зачисляется как credit на account клиента для будущих платежей.
5. Мы просим вас сохранять вежливость в общении с нашим staff. В ответ наша team будет относиться к вам с таким же уважением. Client, который ведет себя чрезмерно грубо, рискует получить ban account from Appbox.
6. Resale любых Appbox services или их частей строго запрещена. Любой user, уличенный в resale activities, столкнется с immediate account termination without refund. Это включает, но не ограничивается, предоставление paid access to streaming platforms, hosting IPTV services или распространение content за плату.
7. Clients отвечают за сохранение и защиту любых data, stored на их Appbox account. В наших services нет built-in redundancy, и data loss возможна. Мы рекомендуем хранить backups важных файлов у dedicated cloud hosting providers.
8. Appbox оставляет за собой право в любое время по собственному усмотрению изменять prices, storage size, network speed, network capacity и computing resources всех services.
9. Users несут единоличную ответственность за любые data, передаваемые через Appbox platform. Downloading, uploading и sharing copyright-protected files любого типа прямо запрещены.
10. Мы можем update TOS в любое время. Продолжение использования наших Services означает ваше acceptance любых изменений.

Соответствие UK Online Safety Act

В соответствии с Online Safety Act 2023 (OSA) United Kingdom, Appbox строго запрещает использовать наши Services для activities, content и materials, связанных с illegal harms, включая, но не ограничиваясь:

1. Terrorism: content, который продвигает, поощряет или поддерживает terrorist acts или organizations.

2. Child Sexual Exploitation and Abuse (CSEA): любой content или activity, связанные с sexual exploitation или abuse of children.

3. Grooming: content или communications, предназначенные для выстраивания отношений с ребенком с целью sexual exploitation.

4. Child Sexual Abuse Material (CSAM): production, distribution или possession материалов, изображающих sexual abuse of children.

7. Controlling or coercive behaviour: content, который продвигает или демонстрирует patterns of controlling or coercive behavior in relationships.

8. Intimate image abuse: sharing of private sexual images without consent (часто называется "revenge porn").

9. Extreme pornography: content, изображающий действия, угрожающие жизни, причиняющие serious injury или включающие sexual acts with animals or corpses.

10. Sexual exploitation of adults: content, связанный с принуждением или manipulation взрослых к sexual activity.

12. Unlawful Immigration: content, продвигающий или facilitating illegal immigration.

13. Fraud and financial services offences: content, продвигающий deceptive practices для получения financial advantage.

15. Drugs and psychoactive substances: content, продвигающий illegal sale controlled drugs или psychoactive substances.

18. Foreign interference: deliberate dissemination of false information с целью manipulation democratic processes.

Кроме того, Appbox запрещает следующие tools, programs и activities:

• Security Threats: activities, которые compromising security of system resources или accounts without authorization.

• Illegal Software and IP Violations: use, transmission или distribution любых data или material, protected by Intellectual Property Rights, без proper authorization.

• Unauthorized Access: intentional access к computer system или infrastructure without authorization либо exceeding authorized access levels.

• Cyberattacks: spamming, phishing, DoS attacks, DDoS attacks или other malicious network activities.

• Tor relays/exit nodes: operation любого типа Tor relay или exit node.

• IPTV hosting or sharing: любая форма IPTV streaming или sharing services.

• VOD (Video on Demand) hosting: hosting unauthorized video content for on-demand streaming.

• Kodi add-ons and repositories: distribution unauthorized Kodi add-ons или repositories.

• Publicly hosted files: operation publicly accessible directories without authentication.

• Hacking utilities: using или distributing tools, designed for unauthorized access to systems.

• Spam-related software: programs, designed to send unsolicited messages или conduct spam campaigns.

• Fraudulent gateways: operation deceptive payment или access systems.

• Malicious content: любой content, который может повредить reputation Appbox или harm other users.

• Cryptocurrency mining: использование Appbox resources для cryptocurrency или other forms of mining.

• Peer-to-peer load balancers: operation load balancers для peer-to-peer networks.

• Game servers: running game servers (если они не установлены через наш App Store).

Users, уличенные в hosting или distributing любого prohibited content выше, получат immediate suspension или termination сервиса without refund. Кроме того, в соответствии с UK law мы можем сообщать certain illegal content соответствующим authorities.

Отправка жалоб и модерация контента

Users должны сообщать о любом illegal или harmful content, обнаруженном на нашей platform, через designated reporting channels, указанные в нашей Content Abuse Policy. Мы серьезно относимся к этим reports и будем оперативно investigate and address legitimate concerns.

Когда мы получаем reports о potentially illegal или harmful content:

1. Мы оцениваем content на соответствие нашим policies и applicable laws
2. Мы можем временно restrict access к reported content during investigation
3. Если content violates our policies или law, мы remove it и take appropriate action against the account
4. Мы notify relevant parties о нашем decision и actions taken

Меры соответствия требованиям

4. Cooperation with Authorities: мы будем cooperate with UK regulatory authorities, включая Ofcom, при addressing illegal content. Это включает предоставление information as required by law и compliance with enforcement notices.

Ответственность за аккаунт и сервис

Client должен хранить backups всех data на своем service и защищать их. Мы настоятельно рекомендуем сохранять important information во external cloud solution, поскольку мы специализируемся на application hosting, а не data storage. Наши systems могут fail, и мы не можем guarantee data retrieval в случае hardware или other failures. Appbox не несет ответственности за lost data и не будет нести financial или other liability, если recovery impossible.

Мы рекомендуем устанавливать unique and strong passwords для Appbox Client Area, Control Panel, SSH и other applications. Users должны следовать нашей Password Policy. Для maximum account security мы настоятельно рекомендуем включить two-factor authentication (2FA) на вашей account security page. Любое использование наших services, нарушающее эти Terms, считается TOS violation независимо от того, был ли account compromised.

Age Requirement: наши Services предназначены только для users, которым не менее 18 лет. Используя наши Services, вы represent and warrant, что вам не менее 18 лет. Clients отвечают за то, чтобы любые services, которые они устанавливают или предоставляют через Appbox, не были доступны лицам младше 18 лет. Sharing and Reselling

Запрещено предоставлять general public доступ к нашим services. Это включает public HTTP directories, hosting video streams или создание publicly accessible services. Если мы обнаружим, что client сделал какие-либо services публичными, мы попросим restrict access; continued non-compliance приведет к account termination.

Services Appbox предназначены для personal use. Мы разрешаем minor sharing installed applications или data с family и close friends. Хотя мы уважаем вашу privacy, Appbox может monitor number of unique users, accessing a given application or service, чтобы убедиться в отсутствии unauthorized resale или misuse. Мы не отслеживаем, какие конкретные individuals используют ваши services, только count of unique connections.

Reselling any function of our services строго запрещено. Любой individual, обнаруженный receiving payment или other compensation in exchange for access to our services, получит immediate account termination и не получит refund.

Fair Usage

Поскольку наши Services rely on shared resources, clients отвечают за то, чтобы их usage не оказывал негативного влияния на других. All users должны удерживать resource consumption в appropriate limits. Appbox оставляет за собой право без предварительного уведомления halt any applications, которые disrupt other clients' activities, и может reallocate resources, если сочтет их misused. В extreme cases of abuse service клиента может быть suspended или terminated. Наша основная цель — обеспечить всем positive experience.

Appbox не несет ответственности за any harm or losses, которые вы можете понести в результате таких действий, и мы не issue refunds for client fees, если services interrupted при этих circumstances. Users соглашаются не нарушать использование services другими customers unfair или malicious способом, который лишает их ожидаемого service level.

Платежи

Мы отправляем invoices за 10 дней до due date, плюс reminder за три дня до нее. Если invoice остается unpaid на due date, service будет suspended. Дополнительные reminders отправляются на day 1, day 4 и day 9 после due date. Если payment остается outstanding к 10-му дню в 00:00 UTC, service terminated, и все data removed permanently. Любой payment после этого времени приводит к completely new service и не qualifies for refund under our policy.

Chargebacks and Disputes

В случае chargebacks и unfair disputes Appbox оставляет за собой право предоставить relevant information, как разрешено нашей Data Handling Policy, нашим payment processors. Используя наши Services, вы соглашаетесь сначала решать любые issues напрямую с нами. Initiating a chargeback или dispute с любым payment processor, чтобы forcibly remove funds from us, считается violation этих Terms.

Конфиденциальность

Customer acknowledges and agrees to the Appbox Privacy Policy.

Неоплата

В случае nonpayment Appbox сохраняет option to delete или keep any content stored on our servers.

Обновления software и service

Мы можем update или modify software, поставляемое с Services, в любое время. Эти updates часто касаются quality improvements и bug fixes. Используя наши Services, вы accept такие updates.

Common Carrier

Appbox и customer agree, что как service provider Appbox operates as a common carrier. Customer считается publisher of any data or materials it distributes, что делает его ответственным за compliance with these Terms. Хотя Appbox не proactively monitor или censor data, shared by our customers, мы maintain compliance with the UK Online Safety Act 2023 и other applicable laws regarding illegal and harmful content. As required by these laws, мы implement appropriate systems for reporting, removing, and preventing redistribution of such content. Роль Appbox в distributing customer-supplied material не означает endorsement или any assurance of compliance with the Terms.

Уведомления

Any notices pertaining to these Terms могут быть sent via email, delivered in person или directed to any location or method specified in writing by the parties involved.

Appbox не гарантирует security или confidentiality of content transmitted over the Internet или through other external network or service providers. This includes indemnification for any penalties or fines imposed on Appbox by regulatory authorities as a result of your violation of the Online Safety Act or other applicable laws.

DISCLAIMER OF WARRANTIES

ALL SERVICES ARE PROVIDED BY APPBOX ON AN "AS IS, AS AVAILABLE" BASIS. APPBOX EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES SHALL APPBOX BE HELD LIABLE FOR ANY INDIRECT, SPECIAL, OR INCIDENTAL DAMAGES, EVEN IF APPBOX HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. IF SERVICE IS INTERRUPTED OR MALFUNCTIONS FOR ANY REASON, APPBOX WILL NOT BE RESPONSIBLE FOR ANY LOSS OF INCOME RESULTING FROM THE OUTAGE OR MALFUNCTION.
